How to Appeal
After review and any necessary proceedings the Maryland Public Employee Relations Board (PERB) issues a decision and employees may appeal for reconsideration.
Who Can Appeal?
Anyone who has received a decision, in any form, from the Maryland Public Employee Relations Board (PERB) have the right to appeal that decision under Title 10, Subtitle 2 of State Government Article, Annotated Code of MD Sec 10-222, and Maryland Rules 7-201 et. seq.
Maryland Rule 7-202 requires the appeal to be done by a petition for judicial review to a Maryland Circuit Court. Rule 7-202 even provides the caption to use for such a petition.
The decision may be reviewed - PDFat a hearing conducted by the Maryland Office of Administrative Hearings (OAH). OAH is not a court. If you disagree with the outcome of a final administrative decision made by OAH or another state agency, you can ask a circuit court to review that decision.
